As the trial court aptly observed, the procedural life of this case is extraordinarily "tortured and star-crossed." Among other things, eight rescheduled inquiry dates, two mistrials, three replacements of defense counsel (including one because of a suicide and another because of a understanding breakdown mid-trial), one interlocutory appeal by the prosecution, and two petitions to the chief court by defendant preceded entry of the dismissal on the blink. Approximately one year later, the United States Excellent Court issued an opinion changing the landscape of constitutional nimble trial challenges in a manner material to this case.

When I started out as a tiro camper, this instrumentality was not on the rota of gear to foothold.
